The actual production and delivery of the products is the responsibility of the individual case.

Article 2 - Conclusion of the agreement with Killer Poke

An agreement (order) between you and Killer Poke is concluded as soon as your order is received via https://www.killerpoke.be/, whether you pay online or in cash upon pickup or delivery. Customers are therefore liable for the amount of the products they ordered.

Article 3 - Termination of the agreement (order) with Killer Poke

The order can be cancelled by the customer free of charge at any time, but not retroactively for deliveries that have already taken place, within the conditions stated below. Cancellation is only valid if the customer requests it on the same day of the order by phone at 032363656. Cancellation will only take effect if the order has not yet been placed with the relevant business and confirmation has been received from the business. Processing and any shipments will stop once the order has been cancelled on time and in accordance with the conditions above. Article 4 – Intellectual Property Rights

Article 5 - Delivery and returns of products (if applicable)

In this case, the customer will be contacted to find an alternative solution. The quality and shipping of the products are the responsibility of the respective business. To inquire about the status of your delivery or to report a delivery error, please first contact the business in question by phone as stated in the confirmation email. However, the customer is entirely responsible for returning the products.

Article 6 – Payment

Depending on the conditions of the business in question, the amounts charged can be paid in cash, online payments, or by invoice. Online payment options include payments via Bancontact, credit card, or bank transfer via online banking. If the online payment invoice is refused by the financial institution, Killer Poke reserves the right to immediately interrupt the order until the payment has been accepted by the financial institution and/or sufficient funds have been deposited into the Local Credit balance. In the event of non-payment by credit card, Bancontact, or home banking, Killer Poke reserves the right to cancel the customer's current order and any potential delivery, without notice and with immediate effect. Killer Poke cannot be held responsible for the non-delivery of products if the minimum order amount is not reached. In this case, the amounts already paid will be credited to the Local Credit balance. All costs associated with collecting unpaid invoices are fully chargeable to the customer.

Article 7 – Customer Use

Killer Poke makes every effort to deliver high-quality products to its customers. Any misuse of the online ordering system as offered on the website is punishable. Misuse is defined as any action taken that exceeds the normal "due diligence" of the online ordering system. Some examples (but not limited to) of abuse include: ordering products for pickup and paying in cash, then failing to collect the products from the store before the designated pickup time, and falsely declaring non-receipt or non-receipt of the products. In the event of abuse, Killer Poke reserves the right to claim damages, as well as interest and administrative fees, which will be calculated at €50 per order, VAT included.
